FamTales Terms of Service

1. Description of Service

FamTales is a personalized storybook application that uses artificial intelligence to create illustrated stories featuring your family members as characters. The App is designed for families with children ages 2-12.

2. Eligibility and Account Registration

Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a FamTales account and make purchases. The App is intended for use by parents, guardians, and caregivers on behalf of their families.

Account Creation

You must sign in with Apple to use FamTales. You are responsible for:

• Maintaining the security of your account
• All activity that occurs under your account
• Ensuring that children use the App under appropriate supervision

Parental Responsibility

By using FamTales, you represent that you have the authority to create profiles for any family members or children you add to the App.

3. Subscription and Payments

Free Tier

FamTales offers a free tier that includes:

• 1 story (lifetime limit)
• Full access to story library
• Audio narration
• Unlimited family members

Premium Subscription

The FamTales Premium subscription ($9.99/month) includes:

• Unlimited story creation
• All free tier features

Story Packs

Story Packs (5 stories for $3.99) are available as one-time purchases. Story Pack credits never expire.

Billing

• Subscriptions are billed through your Apple ID account
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No refunds are provided for partial subscription periods

Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal.

4. Print-on-Demand Services

FamTales offers the ability to order printed physical copies of your stories through our print-on-demand partner. Print orders:

• Are available to all users regardless of subscription status
• Are priced separately from subscriptions
• Are fulfilled by our third-party printing partner
• Are subject to the printing partner's terms and shipping policies

Shipping times, costs, and availability vary by location.

5. Content and Intellectual Property

Your Content

You retain ownership of the family information you provide (names, attributes, etc.). By using FamTales, you grant us a license to use this information solely to generate personalized stories for you.

Generated Content

Stories, illustrations, and audio generated by FamTales are created for your personal, non-commercial use. You may:

• Read and share stories with your family
• Order printed copies for personal use
• Share screenshots or excerpts on social media for non-commercial purposes

You may not:

• Sell or commercially distribute generated stories
• Use generated content to train AI models
• Claim exclusive ownership of AI-generated illustrations

Our Content

FamTales, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

6. Acceptable Use

You agree not to:

• Use FamTales for any unlawful purpose
• Attempt to generate inappropriate, offensive, or harmful content
• Circumvent any security features or usage limits
• Use automated systems or bots to access the App
• Impersonate others or provide false information
• Interfere with the operation of the App
• Violate any applicable laws or regulations

Content Safety

Our AI systems include safety filters to ensure age-appropriate content. We reserve the right to refuse service or terminate accounts that attempt to circumvent these filters or generate inappropriate content.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Service Availability

No Guarantee of Availability

We strive to keep FamTales available, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to:

• Maintenance or updates
• Technical difficulties
• Circumstances beyond our control

Third-Party Services

FamTales relies on third-party services for story generation, illustration, and narration. These services may occasionally be unavailable or produce unexpected results. We are not responsible for the availability or output of third-party services.

Offline Access

Stories you have created are stored locally and can be read offline. Story creation requires an internet connection.

9. Disclaimers

"As Is" Service

FAMTALES IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI-Generated Content

Stories and illustrations are generated by artificial intelligence. While we implement safety measures, we cannot guarantee that all generated content will meet your expectations or be free from errors.

No Professional Advice

FamTales is for entertainment purposes only. Stories are fictional and should not be relied upon for educational, medical, or professional guidance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMTALES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages exceeding the amount you paid to us in the twelve (12) months preceding the claim

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless FamTales and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share using the App

12. Termination

By You

You may stop using FamTales at any time by deleting the App. To delete your data, use the "Delete All Data" option in Settings before uninstalling.

By Us

We may suspend or terminate your access to FamTales at any time, with or without cause, including if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We discontinue the service

Upon termination, your right to use FamTales ends immediately. Locally stored data remains on your device until you delete it.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by updating the "Last Updated" date. Your continued use of FamTales after changes constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to contact us at legal@famtalesapp.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration Agreement

Any disputes arising from these Terms or your use of FamTales shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamTales regarding the App.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

17. Apple-Specific Terms

These Terms are between you and FamTales, not Apple. Apple has no obligation to provide maintenance or support for FamTales. If FamTales fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if applicable). Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to FamTales or your use of it.
